Terms of Service
1. Introduction
1.1. Welcome to the eClass E-Commerce Trading Platform. Before using the services available on eClass, users are required to carefully read the Terms and Conditions and the Operating Regulations to understand their legal rights and obligations with regard to TRI LINH COMMERCIAL AND SERVICES CO., LTD.
eClass provides or makes available the following:
- eClass homepage,
- Services offered by the eClass website and the software available for eClass customers on the eClass website,
- All information, links, features, data, text, images, diagrams, audio, video, messages, programs, lesson plans, service applications, or other materials available on the eClass website or services related to the eClass website.
Any new features added or expanded to the Services will also be governed by these Terms of Service. These Terms of Service regulate your use of the Services provided by eClass.
1.2. eClass is an intermediary platform connecting individuals such as teachers, students, and lecturers (Sellers) who have the ability and desire to impart knowledge with learners (Buyers) who need to study or improve their learning.
Before using the eClass website, you must read and accept the Terms of Service, regulations, policies, and the eClass Privacy Policy. By creating an account on eClass, you agree to these Terms of Service. If you do not agree, you are not permitted to use the eClass website.
1.3. eClass reserves the right to modify, suspend, or terminate the eClass website or Services at any time, and trial versions may differ from the final version.
eClass reserves the right to refuse an account registration or service access request if the user does not comply with eClass's regulations.
If you are a minor or have limited legal capacity, you need the consent or assistance of your parent or legal guardian to use eClass services.
Parents or legal guardians must support or represent minors in understanding and accepting the Terms of Service and take responsibility for the use of the eClass account or services.
2. Privacy and Use of Information
2.1. eClass values the privacy and security of your information. To protect users' rights, eClass provides a Privacy Policy that explains in detail the security practices followed by eClass. Please refer to the Privacy Policy to understand how eClass collects and uses information related to your Account and/or your use of the Services ("User Information"). These Terms of Service are closely linked with the Privacy Policy. By using the services available on eClass, users will:
- Allow eClass to collect, use, disclose, and/or process your personal content, data, and User Information as outlined in the Privacy Policy;
- Agree and acknowledge that the information provided on the eClass platform will be jointly owned by you and eClass; and
- Not, either directly or indirectly, disclose User Information to any third party, or by any means allow any third party to access or use your User Information.
3. Intellectual Property Regulations
eClass grants users the right to access and use the platform in accordance with the terms and conditions outlined on the website. All content on eClass and the content displayed on the eClass website is owned by eClass (Intellectual Property Assets).
3.1. Rights to Use Intellectual Property Assets: Users accessing the eClass website do not have the right to copy, use, or claim ownership of any Intellectual Property Assets of eClass. By using or accessing the services, you agree to comply with applicable laws regarding copyrights, trademarks, service marks, and other protective rights related to eClass’s services and content.
3.2. Restrictions on Copying and Distribution: You are not permitted to copy, distribute, modify, reproduce, sell, rent, or create derivative works from any part of the eClass website. You may not copy eClass content to your own server or other websites without prior written consent from eClass.
3.3. Prohibition on Automated Tools: You are prohibited from using automated tools, such as robots or spiders, to collect, copy, or monitor eClass content without prior permission from eClass.
3.4. Commitment to Protecting Intellectual Property Rights: eClass is committed to protecting the intellectual property rights of all parties involved and will actively manage the content on the website to prevent unauthorized infringement or alteration.
3.5. Intellectual Property Rights Infringement Procedure: If you are the owner or representative of the intellectual property rights and believe your rights have been violated, you may file a complaint with eClass. You will need to provide supporting documentation, and eClass will process and respond to your request as soon as possible.
4. TERMS OF USE
4.1. Rights and Responsibilities of Partners (Instructors/Service Providers)
a) Rights of Instructors/Service Providers
- Users who participate on the eClass e-commerce platform can register a free account with a unique username and password to conduct transactions.
- Instructors and service providers are entitled to contribute suggestions for improving the products on the eClass e-commerce website.
- Sellers have the right to offer products (courses) that are appropriate and have clear content on the eClass platform.
- Sellers have the right to file complaints regarding issues that arise in transactions or that affect their legal rights.
- Instructors/service providers can receive consultation and support from the eClass platform staff in transaction methods and using the platform’s features.
- Members can benefit from promotions and policies posted directly on the eClass website.
- Instructors/service providers have the right to provide feedback to eClass during the operation of the platform. Suggestions can be submitted via mail, fax, or email to eClass.
b) Responsibilities of Instructors/Service Providers
- Instructors/service providers are committed to providing accurate and complete information when registering for services or placing orders on the eClass e-commerce platform, including full name, contact address, email, phone number, etc.
- Members are responsible for maintaining the confidentiality of their login credentials and any activities carried out under their registered name, password, or email account.
- Instructors/service providers are responsible for providing transaction information and details about goods/services to support the resolution of any disputes or conflicts between buyers and sellers.
- Instructors/service providers agree not to use the eClass platform for illegal activities, fraud, data mining, distributing viruses that may harm the system, configurations, or communication systems of the website, and not to create fake orders for any reason, including market demand predictions. Any violation of these terms will be subject to legal consequences.
- Instructors/service providers may not alter, modify, copy, or distribute tools similar to those on the eClass platform to any third parties.
- Instructors/service providers are prohibited from taking any action or disseminating information that could damage the reputation of the eClass platform in any form.
4.2. Rights and Responsibilities of Customers (Students/Users)
a) Rights of Students/Service Users
- Members participating on the eClass platform can register for a free account with a unique username and password to conduct transactions.
- Students have the right to contribute suggestions for improving the products offered on eClass and to rate or review instructors to improve service quality.
- Buyers have the right to explore, reference, and freely buy/sell products listed on eClass.
- If any issues arise related to transactions or that affect the legal rights of members, students have the right to file complaints with the eClass administration team.
- Students can benefit from promotions, discounts, and support offered by eClass in relation to transactions and using platform features.
- Students have rights related to the confidentiality and protection of their personal information.
b) Responsibilities of Students/Service Users
- Students registering for services or placing orders on eClass must ensure that all provided information is accurate, including full name, contact address, email, phone number, etc.
- eClass will implement privacy policies to protect student information. However, students are responsible for keeping their login credentials secure and for all activities carried out under their registered username, password, or email account.
- In the event of any transaction-related issues or conflicts, students must provide accurate and complete information to the eClass administration to assist in resolving the matter.
- Students agree not to use the eClass platform for illegal activities, fraud, data mining, distributing viruses that could harm the system, configurations, or communication systems of the website, and not to create fake orders for any reason, including market demand forecasting. Any violations will result in full legal responsibility.
- Students are prohibited from altering, modifying, copying, or distributing tools similar to those on the eClass platform to any third parties.
- Students are prohibited from taking any action or disseminating information that could harm the reputation of the eClass platform in any form.
By using the eClass platform, both instructors and students agree to comply with the rights and responsibilities outlined in these Terms of Service.
5. SANCTIONS FOR VIOLATION
5.1. Violating the regulations of eClass may result in several actions, including but not limited to the following:
(a) Warning Notice
(b) Compensation for Damages
(c) Account Suspension
(d) Legal Action according to applicable laws
(e) Criminal Charges
(f) Other actions or sanctions as stipulated in the Community Standards, Operational Regulations, or eClass Policies.
5.2. If you detect a user violating eClass's terms, please contact eClass immediately.
6. ORDERING AND PAYMENT
At any given time, eClass supports one or more payment methods as follows:
- Credit/Debit Card or installment payments using credit card
- Domestic ATM Card – Internet Banking
- International Payment Card
- Other payment methods available on the eClass platform at the time.
To complete the payment, users can follow the payment instructions provided on the platform.
7. ECLASS GUARANTEE POLICY
7.1. eClass Guarantee Policy
The eClass Guarantee Policy is a service provided by eClass to ensure that transactions for buying and selling goods on the eClass platform are carried out securely. To mitigate legal risks, the payment made by the Buyer will be held by eClass. The Seller will be paid according to the terms stipulated in the agreement.
The Guarantee Policy will not apply to transactions where the Buyer and Seller agree on terms independently.
7.2. Transaction Safety Measures
To ensure transaction safety, the website’s administration team will verify the personal information of users as well as the details of the goods or services. Additionally, members of the eClass e-commerce platform are required to follow the registration/login and order placement instructions.
The card payment system on the eClass website is provided by licensed payment gateway partners operating legally in Vietnam. As such, eClass follows the security standards of its payment gateway partners.
Transaction information will be securely protected using SSL encryption (the industry standard for online data security). In case of any security breaches, eClass will seek legal intervention to protect the rights and interests of the parties involved.
7.3. Errors During Payment
If any errors occur during the process of depositing funds for use, users should promptly notify eClass to receive assistance.
Users will not be required to pay any additional fees other than those clearly listed on the eClass platform. If users are asked to pay fees to an account outside of eClass, they should immediately contact the customer support team to report the issue and seek assistance.
7.4. Transactions Outside eClass Platform
eClass will not be responsible for any transactions that are conducted outside of the eClass platform or for transactions that do not fall under the eClass Guarantee Policy.
7.5. eClass Guarantee Policy Scope
The eClass Guarantee Policy is an additional service and does not limit the legal obligations of Buyers and Sellers under the applicable laws.
The eClass Guarantee Policy is not intended to assist Sellers or Buyers in fulfilling their legal obligations, and eClass will not be held responsible for the legal compliance of either party, as mentioned earlier.
8. ORDER CANCELLATION AND REFUND
According to eClass's policy, Buyers may cancel their orders under the following circumstances:
(a) During the “Pending Confirmation” stage;
(b) During the “Confirmed” stage, if there are still 08 hours left before the scheduled class.
In some urgent cases or due to personal issues, eClass will assist users in canceling their class schedules.
Once a class is canceled, the payment will be refunded to the user's account balance. eClass will not refund the money to the user's bank account or any other directly linked payment methods.
9. APPLICABLE LAW
These Terms of Service will be governed by and construed in accordance with the laws of Vietnam. Any dispute, controversy, claim, or disagreement of any kind arising from or related to these Terms of Service, against eClass or any indemnified party under these Terms, will be resolved through the Vietnam International Arbitration Center (VIAC). The language of arbitration will be Vietnamese.
